Planning Conditions
Purpose
This action list considers the powers granted under Section 70 of the Town and Country Planning Act 1990 which allow local planning authorities to impose conditions ‘as they think fit’ on planning permissions. The intention is to enable local authorities to ensure that a broadly acceptable proposal respects local policy and makes a positive contribution to its locality.
Benefits
Not only does this action list study the Act but also cases decided under the Act. In practice, the courts have been at pains to establish the limits of the powers granted under the Act, and central government has developed policy guidelines to ensure that local authorities use them appropriately.
Audience
Urban and regional planners and all those wishing to build and assess their knowledge of the topic.
Learning method
Background, context and a six stage action plan in deciding how and whether to impose a condition on a planning permission. Additionally a comprehensive range of further reading is provided for those who wish to become expert in the subject. Includes voluntary self assessment for recording continuous professional development (CPD).
